1. Account Usage

1.1. Account Creation: Users may create one account per individual. Multiple accounts are not permitted unless explicitly authorized by BetterTok LLC.

1.2. Account Security: You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

1.3. Account Suspension: We reserve the right to suspend or terminate accounts that violate these Terms or engage in prohibited activities at our sole discretion.

2. Use of Unofficial APIs

2.1. Unofficial APIs: BetterTok utilizes unofficial APIs (Application Programming Interfaces) provided by TikTok to retrieve and display data. By using our Service, you acknowledge and agree that we are not affiliated with TikTok and that we use these unofficial APIs to access TikTok data.

2.2. Data Accuracy: While we strive to provide accurate and up-to-date data, we cannot guarantee the accuracy, completeness, or reliability of the information displayed on BetterTok. Users are responsible for verifying any data they rely on from our Service.

3. Service Availability

3.1. TikTok API Changes: BetterTok relies on TikTok's APIs to function correctly. We cannot guarantee the continuous availability or functionality of our Service, as changes made by TikTok to their APIs may affect our ability to provide the Service. We will make reasonable efforts to adapt to such changes but cannot guarantee uninterrupted access.

3.2. Maintenance: We may temporarily suspend the Service for maintenance, updates, or improvements without prior notice. We are not liable for any inconvenience or loss caused by such interruptions.

4. User Responsibilities

4.1. Compliance: Users agree to comply with all applicable laws, regulations, Discord's Terms of Service, TikTok's Terms of Service, and these Terms when using BetterTok.

4.2. Prohibited Activities: Users must not:

• Upload, share, or promote illegal or infringing content
• Attempt to reverse engineer, decompile, or hack the Service
• Use the Service for spam, harassment, or abuse
• Circumvent rate limits or security measures
• Resell or redistribute the Service without authorization
• Use automated tools to access the Service beyond intended use

5. Premium Membership

5.1. Subscription Plans: BetterTok offers premium subscription plans ("BetterTok Pro") that grant users access to additional features and benefits. By purchasing a subscription, you agree to pay the associated fees.

5.2. Billing: Subscription fees are billed on a recurring basis (monthly or annually) to the payment method provided at the time of purchase. You authorize us or our payment processor to charge your payment method for the applicable fees.

5.3. Price Changes: We reserve the right to change subscription prices. Any price changes will be communicated in advance and will take effect at the start of the next billing cycle.

6. Cancellation

You may cancel your subscription at any time through your dashboard settings. Upon cancellation, you will retain access to premium features until the end of your current billing period. No prorated refunds will be provided for unused portions of a subscription period.

7. Refund Policy

7.1. No Refunds: All purchases are final and non-refundable. Due to the digital nature of our Service and immediate access to premium features upon purchase, we do not offer refunds for any subscription payments, including but not limited to:

• Initial subscription purchases
• Renewal charges
• Plan upgrades or downgrades
• Unused subscription time

7.2. Responsibility to Cancel: Users are responsible for cancelling their subscription before the next billing cycle. If a user forgets to cancel, stops using the Service, or no longer streams, this does not constitute grounds for a refund.

7.3. Waiver of Statutory Withdrawal Rights (EU): By purchasing a BetterTok subscription, you acknowledge that the digital service begins immediately and that any statutory right of withdrawal is waived once the service is activated.

8. Intellectual Property

All content, features, functionality, trademarks, and intellectual property of BetterTok are owned by BetterTok LLC and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or reverse engineer any part of our Service without explicit written permission.

9. Disclaimers and Limitations of Liability

9.1. No Warranty: BetterTok is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, uninterrupted, or free of harmful components.

9.2. Limitation of Liability: To the maximum extent permitted by law, BetterTok LLC shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, data, revenue, or business opportunities arising from your use of the Service.

9.3. Third-Party Services: BetterTok integrates with third-party services (Discord, TikTok). We are not responsible for the availability, accuracy, or policies of these third-party services.

10. Termination

BetterTok LLC reserves the right to suspend or terminate your access to the Service at any time, without prior notice or liability, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Service will immediately cease.

11. Changes to Terms

We may update these Terms from time to time. Any changes will be effective upon posting the revised Terms on our website. Your continued use of the Service after any modifications indicates your acceptance of the updated Terms. We encourage you to review these Terms periodically.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
